Resolution RS2018-1154

A resolution dissolving the Special Committee established pursuant to Resolution No. RS2018-1039 and requesting the Office of Internal Audit to present a Report and Recommendations to the full Metropolitan Council.

WHEREAS, on February 6, 2018, the Metropolitan Council adopted Resolution No. RS2018-1039, establishing a Special Committee to investigate the circumstances involving travel and other expenses,
including overtime expenses, potentially related to then-Mayor Megan Barry's admitted improprieties involving an employee of the Metropolitan Government to determine if there was any improper use of public money; and

WHEREAS, Resolution No. RS2018-1039 further provided that, by a resolution passed by the Council, the
Special Committee may engage the services of outside legal professionals; and

WHERAS, Resolution No. RS2018-1039 further directed that the Special Committee shall prepare a Report and Recommendations to the Council about its findings and any recommendations for further action; and

WHEREAS, on March 6, 2018, then-Mayor Megan Barry and former Metropolitan Nashville Police Department Sgt. Rob Forrest entered pleas of guilty before Judge Monte Watkins of the Davidson County Criminal Court Division V of the Twentieth Judicial District effectively resolving the question of whether any improper use of public money had occurred; and

WHEREAS, in response to this change of circumstance, original Resolution No. RS2018-1039 was amended by Resolution No. RS2018-1110 to clarify that the Special Committee should prepare a Report and Recommendations to the Council about its findings, any recommendations for further action, as well as recommendations for additions or revisions to Metropolitan Government Code of Laws, policies, or regulations; and

WHEREAS, at its April 5, 2018 meeting, the Special Committee examined the revised scope of work submitted by the Metropolitan Office of Internal Audit to assist in this investigation and determined that, under the current circumstances, the work of the Special Committee would be duplicative of that of the Internal Audit Committee, which is also charged with investigating how funds were misused; and

WHEREAS, under these emerging circumstances, it is fitting and proper that the Special Committee established pursuant to Resolution No. RS2018-1039 be dissolved, and that the Metropolitan Office of Internal Audit submit a Report and Recommendations to the Metropolitan Council for any necessary further action.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Special Committee established pursuant to Resolution No. RS2018-1039 is hereby dissolved.

Section 2. The Metropolitan Council further requests that the Report and Recommendations developed by the Office of Internal Audit, with oversight by the Audit Committee, be presented to the full Council, providing therein its findings and any recommendations for additions or revisions to Metropolitan Government Code of Laws, policies, or regulations to prevent future similar misuse of funds. The Executive Committee of the Council may thereafter determine if further action is required through any standing committee, through the Committee of the Whole, or through the full Metropolitan Council.

Section 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
