Metropolitan Council Meeting
Tuesday, October 2, 2007


The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Andre Fairley of Eagles Nest Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the special meeting September 25, 2007, were approved.

- ELECTIONS AND CONFIRMATIONS -

President Pro Tempore
The President called for nominations for President Pro Tempore of the Metropolitan Council for a one-year term expiring August 31, 2008. Mr. Ryman nominated Mr. Forkum, which motion was seconded. There being no further nominations, the President declared the nominations closed. Mr. Cole moved to elect Mr. Forkum by acclamation as President Pro Tempore, which motion was seconded and adopted by a unanimous vote of the Council.

Planning, Zoning and Historical Committee
The President called for nominations to elect a chair of the Planning, Zoning and Historical Committee for a two-year term expiring September 30, 2009. Mr. Hodge nominated Mr. Gotto, which motion was seconded. There being no further nominations, the President declared the nominations closed. Mr. Cole moved to elect Mr. Gotto by acclamation as Chair of the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a unanimous vote of the Council.

Traffic and Parking Committee
The President called for nominations to elect a chair of the Traffic and Parking Committee for a two-year term expiring September 30, 2009. Mr. Tygard nominated Mr. Burch, which motion was seconded. There being no further nominations, the President declared the nominations closed. Mr. Cole moved to elect Mr. Burch by acclamation as Chair of the Traffic and Parking Committee, which motion was seconded and adopted by a unanimous vote of the Council.

Audit Committee
The President called for nominations to elect two Council members to the Audit Committee for two-year terms expiring September 30, 2009. Mr. Garrett nominated Mr. Tygard, which motion was seconded. Mr. Steine nominated Mr. Hunt, which motion was seconded. There being no further nominations, the President declared the nominations closed. Mr. Cole moved to elect Messrs. Tygard and Hunt by acclamation to the Audit Committee for two year terms, which motion was seconded and adopted by a unanimous vote of the Council.

Industrial Development Board
Notice was given by the President of three vacancies on the Industrial Development Board of the Metropolitan Government, which vacancies by law are to be filled by the Council. Nominations will be taken at the meeting of October 16, 2007, and an election held to fill the vacancies on November 6, 2007.

Mr. Ryman moved to change the date of the January 2008 public hearing from Tuesday, January 1, 2008, to Tuesday, January 8, 2008, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-1

A resolution approving the account based self-insured medical benefits plan for employees and pensioners under Section 3.08.110(E) of the Metropolitan Code of Laws. RESOLUTION NO. RS2007-2

A resolution establishing a task force to assess and recommend improvements to the public safety infrastructure for the Metropolitan Government. The Public Safety-Beer and Regulated Beverages Committee recommended deferment. A document was filed for the record in this matter. Mr. Stanley moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-3

A resolution accepting a grant from the Alcohol and Drug Council of Middle Tennessee to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for liaison services between Juvenile Court, schools, and families residing in the Sudekum-Napier Community. The resolution was approved by the Budget and Finance Committee. An ordinance amending Chapter 6.80 of the Metropolitan Code pertaining to the “booting” of vehicles within the area of the Metropolitan Government. BILL NO. BL2007-5

An ordinance authorizing Tennessee Independent Telecommunications Group, LLC d/b/a Iris Networks, to construct, install, and maintain fiber optic cable within Davidson County, Tennessee, all of which is more particularly described herein (Proposal No. 2007M-154). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2007-6

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning Lakeland Court (Proposal No. 2007M-126U-14). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works, Traffic and Parking and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning Alley Number 222 right-of-way (Proposal No. 2007M-162U-08). The bill was approved by the Planning Commission. BILL NO. BL2007-10

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from Office/Residential (OR20) to Specific Plan (SP) zoning property located at 429 Veritas Street (0.34 acres) for development plan and final site plan approval to permit the existing 2,800 square foot building to be used for one single-family dwelling, general office, or light manufacturing/general retail to permit one upholstery shop only, all of which is described herein (Proposal No. 2007SP-126U-11). The bill was approved by the Planning Commission. BILL NO. BL2007-11

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning properties located at 304, 306 and 308 White Bridge Pike, approximately 120 feet north of Burgess Avenue (0.38 acres), to permit a 2,400 square foot car wash facility, all of which is described herein (Proposal No. 2007SP-159U-07). BILL NO. BL2007-12

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Planned Unit Development Overlay District on property located at 4148 Clarksville Pike, at the southeast corner of Clarksville Pike and Kings Lane, (4.05 acres), zoned CL, to permit the development of a 30,521 square foot recreation center (family life center) and 9,600 square feet of office uses, replacing retail uses, all of which is more particularly described herein (Proposal No. 89P-030U-03). The bill was approved by the Planning Commission. BILL NO. BL2007-13

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning and for final site development approval for property located at 1510 Lebanon Pike, approximately 200 feet east of Spence Lane (1.77 acres), to permit automobile convenience, vehicular rental/leasing, vehicular sales and service, limited, and all other uses permitted by the CS zoning district, all of which is described herein (Proposal No. 2007SP-155U-14). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-14

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing CN and RS5 to SP zoning properties located at 927, 929, 1001, and 1003 Lischey Avenue, on the east side of Lischey Avenue at Vernon Winfrey Avenue (0.74 acres), to permit 6 single-family homes, 3 townhome units, and a 2-story mixed-use building, all of which is described herein (Proposal No. 2007SP-162U-05). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-15

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling 3 properties from the Music Row Urban Design Overlay (UDO) district located at 1701, 1707 Broadway and 115 17th Avenue South, southwest corner of Broadway and 17th Avenue South (.99 acres), zoned CF and proposed for SP district, all of which is more particularly described herein (Proposal No.2001UD-002U-10). The bill was approved by the Planning Commission. Ms. Gilmore moved to withdraw the bill since the developers are not proceeding in this way, the bill being requested by Barge, Waggoner, Sumner & Cannon, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-16

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF to SP property at 1701, 1707 Broadway and 115 17th Avenue South, southwest corner of Broadway and 17th Avenue South (.99 acres), to permit 206 residential units, 10,750 square feet of retail and restaurant uses, 387 space parking garage, all of which is described herein (Proposal No. 2007SP-158U-10). Ms. Gilmore moved to withdraw the bill since the developers are no longer proceedings in this way, the bill being requested by Barge, Waggoner, Sumner & Cannon, which motion was seconded and adopted by a voice vote of the Council..

BILL NO. BL2007-17

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM9 zoning property located at 1402 Rural Hill Road, approximately 930 feet north of Mt. View Road (4.15 acres), all of which is described herein (Proposal No. 2007Z-144U-13). The bill was approved by the Planning Commission. Mr. Duvall moved to defer the bill indefinitely while the land use policy for the area is being studied, the bill being requested by Jay Nelson, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-18

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 and SCR to CL zoning properties located at 611 Old Hickory Boulevard, approximately 1,230 feet south of I-40 (2.7 acres), all of which is described herein (Proposal No. 2007Z-154G-06). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-19

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying the historic overlay district to 510 properties in Germantown bounded by Rosa Parks Boulevard, Jefferson Street, Hume Street, and 2nd Avenue North (92.5 acres), zoned R6, SP, OR20, MUN, MUG, CS, CF, and IR and within the Phillips-Jackson Redevelopment District, all of which is described herein (Proposal No. 2007Z-167U-08). Ms. Gilmore moved to defer the bill indefinitely so that a community meeting can be held on the proposal, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-20

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing R10 to SP zoning property located at 942 Riverside Drive, approximately 140 feet south of Rosebank Avenue (0.58 acres), to permit the development of 3 new, detached, single-family townhomes and to retain 1 existing single-family home, all of which is described herein (Proposal No. 2007SP-118U-05). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-21

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing RS7.5 and CS to SP zoning on 88 properties abutting Myatt Drive from State Route 45 (Old Hickory Boulevard) to Anderson Lane and abutting Anderson Lane from May Drive to Rio Vista Drive (34.04 acres), to permit mixed uses along Myatt Drive, and mixed uses and mixed housing types along Anderson Lane, all of which is described herein (Proposal No. 2007SP-165G-04). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-22

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing RS20 to SP zoning properties located at 1170 Dickerson Pike and Dickerson Pike (unnumbered), approximately 1,590 feet east of W. BILL NO. BL2007-25

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to SP zoning a portion of property located at 1500 Old Hickory Boulevard, approximately 485 feet west of Brick Church Pike (3.59 acres), to permit a 49,700 square foot assisted-living facility with 69 units, all of which is described herein (Proposal No. 2007SP-146G-02). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-26

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning properties located at Bell Road (unnumbered), at the southeast corner of Old Hickory Boulevard and Bell Road (6.34 acres), to permit a 2-story, 31,200 square foot business school, all of which is described herein (Proposal No. 2007SP-156U-12). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing a portion of property from AR2a to IWD at 12848 Old Hickory Boulevard, approximately 1,790 feet south of Old Franklin Road, (.22 acres), all of which is described herein (Proposal No. 2007Z-161G-13). BILL NO. BL2007-28

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing IR, IWD, and RS7.5 to CS zoning properties located at 700 Edenwold Road and Edenwold Road (unnumbered), approximately 1,370 feet east of Gallatin Pike (46.93 acres), all of which is described herein (Proposal No. 2007Z-152G-04). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-29

An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending the 31st Avenue/Long Boulevard Urban Design Overlay (UDO) district, to establish parking locations, maximum raised foundation heights for particular building types, maximum building heights in feet and stories, and permitted roof types, and to clarify when architectural treatment standards apply and establish additional stormwater management requirements all of which is more particularly described herein (Proposal No. 2005UD-006U-10). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-30

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM20 zoning property located at 3214 Murfreesboro Road, approximately 1,590 feet north of Mt. View Road and located within the Hamilton Hills Urban Design Overlay district (9.6 acres), all of which is described herein (Proposal No. 2007Z-157U-13). Mr. Duvall moved to defer the bill indefinitely while other zoning options and the land use policy are considered, the bill being requested by Digidata Corporation, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-31

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to MUL zoning property located at 1515 Lebanon Pike, southeast corner of Lebanon Pike and Spence Lane (1.5 acres), all of which is described herein (Proposal No. 2006Z-058U-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-32

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning properties located at 3781, 3791, 3799, and 3803 Pin Hook Road and Pin Hook Road (unnumbered), approximately 2,430 feet west of LaVergne Couchville Pike (19.29 acres), to permit 39 multi-family units and 60 single-family lots, all of which is described herein (Proposal No. 2007SP-151U-13). Mr. Coleman offered a substitute bill and moved that it be accepted for filing and no objection was made.

BILL NO. BL2007-36

A request to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, to amend the requirements that allow the floor area of parking garage liner buildings fronting a public street or public space to be exempt from the calculation of floor area ratio by establishing different requirements for residential and non-residential uses (Proposal No. 2007Z-169T). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-37

An ordinance amending Section 17.04.060 of Title 17 of the Metropolitan Code, Zoning Regulations, to clarify that paved loading areas and tractor-trailer staging, loading, and parking areas and not considered structures under the Zoning Code, all of which is more specifically described herein (Proposal No. 2007Z-170T). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2007-1

An ordinance amending Ordinance No. BL2007-1312, as amended, regarding the date of the special assessment to be levied on real property within the area of the Downtown Central Business Improvement District. The substitute bill was approved by the Budget and Finance Committee. Mr. Jameson moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

The bill was approved by the Rules-Confirmations-Public Elections Committee. Ms. Page moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

A resolution proclaiming October 18th as Mediation Day in Nashville, Tennessee. The resolution was approved by the Rules-Confirmations-Public Elections Committee.
