Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Mr. Chris Choate.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Garrett, Tygard, Maynard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Pardue, Jernigan, Glover, Stanley, Claiborne, Tenpenny, Moore, Allen, Gilmore, Baker, Langster, Evans, Holleman, McGuire, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Todd, Mitchell and Neighbors (38); Absent: Stites, Weiner, Duvall (3).

The Minutes of the regular meeting of November 19, 2013, were approved.

- PROPOSED RULES AMENDMENT -

Rule 47 of the 2011-2015 Rules of Procedure of the Council, as amended, be amended by deleting the last sentence in its entirety and substituting with the following:

“If the Metropolitan Clerk is directed to send a copy of a nonbinding memorializing resolution to an individual, group of individuals, department, or agency upon adoption of the resolution, and if such resolution does not receive a unanimous affirmative vote of the Members of Council present at the meeting at which the resolution is considered, then the Clerk shall transmit a copy of the actual Council vote along with the copy of the resolution.”

At the request of the sponsor the proposed amendment was deferred.

- ELECTIONS AND CONFIRMATIONS -

Convention Center Authority
Appointment of Ms. Irwin Fisher for a term expiring September 30, 2017. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Without objection RS2013-926 were taken out of order.

RESOLUTION NO. RS2013-926

A resolution confirming the appointment of Irwin Fisher to the board of directors of The Convention Center Authority of the Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee. Ms. Barry moved to adopt the resolution, which motion was seconded and adopted by the following vote:

Metropolitan Development and Housing Agency
Reappointment of Mr. Melvin Black for a term expiring November 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Stormwater Management Committee
Reappointment of Mr. Roy Dale for a term expiring October 31, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Clerk
Appointment of Ms. Shannon Hall effective December 3, 2013. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

A resolution exempting Two Ten Jack located at 1900 Eastland Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Westerholm requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL, MUL, SP, RS10, OR20, CN and R6 to MUN-A and MUL-A zoning for various properties located along Maxey Lane, McGavock Pike, Oxford Street and Riverside Drive, between Oxford Street and Geneiva Drive (5.92 acres), all of which is described herein (Proposal No. 2013Z-034PR-001). The bill was approved by the Planning Commission. Mr. Anthony Davis requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2013-586

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Eastwood Neighborhood Conservation Overlay District to various properties located along Eastland Avenue and Scott Avenue, between Porter Road and Chapel Avenue (2.45 acres), all of which is described herein (Proposal No. 2013NHC-002-001). The bill was approved by the Planning Commission. Mr. Westerholm requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. BILL NO. BL2013-587

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning for properties located at 4900, 4902, 4904 and 4906 Tennessee Avenue, at the northwest corner of Tennessee Avenue and 49th Avenue North (0.7 acres), to permit up to nine residential dwelling units, all of which is described herein (Proposal No. 2013SP-027-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Baker requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2013-588

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located within the Woodland-in-Waverly Historic Preservation District at 2107, 2111, and 2115 White Avenue, approximately 195 feet south of Prentice Avenue (0.57 acres), to permit up to 8 residential dwelling units, all of which is described herein (Proposal No. 2013SP-033-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Moore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Ms. Moore moved to defer the bill to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-589

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located at 1505 and 1507 Porter Road and for a portion of properties located at 1516 and 1528 C Riverside Drive, approximately 200 feet south of Cahal Avenue, (1.89 acres), to permit up to 28 residential dwelling units and up to 6,000 square feet of commercial space, all of which is described herein (Proposal No. 2013SP-030-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Anthony Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-590

An ordinance to amend Section 17.32.050 of the Metropolitan Zoning Code to prohibit LED message boards and digital display signs within the ORI-A zoning district (Proposal No. 2013Z-013TX-002). The bill was approved by the Planning Commission. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. RESOLUTION NO. RS2013-903

A resolution exempting Frothy Monkey located at 2509 12th Avenue South from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee.

RESOLUTION NO. RS2013-921

A resolution to approve the second amendment to the lease agreement between The Metropolitan Government and Square Investment Holdings, LP for office space in the Washington Square Building located at 222 Second Avenue North (Proposal No. 2011M-002PR-002). The resolution was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2013-922

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, to divert felony offenders from the Tennessee prison system by providing community supervision and treatment services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-923

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to establish and enforce federal and state mandated child support program guidelines for children born out of wedlock. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-924

A resolution accepting a grant from the U. S. Department of Health and Human Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to create a comprehensive strategy to address issues and barriers to responsible fatherhood. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-925

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Anita Ransom against the Metropolitan Government of Nashville and Davidson County in the amount of $10,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-927

A resolution recognizing Shirley Blackburn for her 40 years of outstanding service to the Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

A resolution recognizing Kathleen Callaghan for her 35 years of outstanding service to the Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

An ordinance approving the issuance of one or more series of Public Improvement Revenue Bonds (Ballpark Project) by The Sports Authority of The Metropolitan Government of Nashville and Davidson County; authorizing the Metropolitan Government's execution and delivery of a trust indenture relating to said bonds; authorizing the Metropolitan Government's execution and delivery of an intergovernmental agreement relating to said bonds and development of the ballpark; authorizing the pledge of certain of the Metropolitan Government's revenues as security for the bonds; and authorizing an official statement to be distributed in connection with the sale of the bonds. The bill was approved by the Budget and Finance and Convention, Tourism and Public Entertainment Facilities Committees. Mr. Steine moved to pass the bill on second reading, which motion was seconded. An ordinance to amend Chapter 11.12 of the Metropolitan Code pertaining to the noise from buses parked near hotels and motels within the commercial attraction (CA) zoning district. An ordinance amending Chapter 6.74 of the Metropolitan Code relating to other passenger vehicles for hire. BILL NO. BL2013-606

An ordinance authorizing the Metropolitan Nashville Arts Commission to accept donations or sponsorships to help cover its costs associated with the Americans for the Arts 2014 Annual Convention; and, appropriating those funds to the Metropolitan Nashville Arts Commission for that purpose. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-607

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Alley No. 384 and Alley No. 387 right-of-way (Proposal No. 2013M-015AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the 4300 Clarksville Pike Stormwater Improvement Project for property located at 4300 Clarksville Pike A(Project No. 14-SWC-079 and Proposal No. 2013M-050ES-001). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 350 linear feet of an existing eight inch public sewer main and easement and to accept approximately 334 linear feet of eight inch P.V.C. public sewer and 87 linear feet of eight inch D.I.P. public sewer main and easement for properties located at 1400 14th Avenue South, 1441, 1441B, and 1443 12th Avenue South (MWS Project No. 13-SL-56 and Proposal No. 2013M-053ES-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights of former alley No. 926 (closed via Council Ordinance O60-119) and former Alley No. 925 (closed via Deed Book 2343, Page 409) for properties located at 407 23rd Avenue North, 2300 Charlotte Avenue and 2400 Charlotte Avenue (Proposal No. 2013M-054ES-001). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located at 700 and 704 Porter Road and 2009 Eastland Avenue, approximately 200 feet south of Franklin Avenue (0.66 acres), to permit up to 11 detached single-family residential units, all of which is described herein (Proposal No. 2013SP-040-001).
