ORDINANCE NO. O98-1384
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the State of Tennessee, Department of Transportation, for Enhancement of the Andrew Jackson Aquifer.
WHEREAS, Federal surface transportation funds have been appropriated to the Tennessee Department of Transportation for use in a project to enhance the Andrew Jackson Aquifer; and
WHEREAS, the Capital Improvements Budget, CIB No. 97PW039 has appropriated matching funds for said purpose, Project No. STP-EN-1900(16); and
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County to enter into the attached agreement with the State of Tennessee, Department of Transportation for the purpose above stated,
NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
SECTION 1: The Agreement submitted by the Department of Transportation of the State of Tennessee to The Metropolitan Government of Nashville and Davidson County concerning Project STP-EN-1900(16), Enhancement of the Andrew Jackson Aquifer is attached hereto and made a part thereof the same as though copied herein.
SECTION 2: The Metropolitan County Mayor is authorized to execute the attached Agreement and any and all future documents necessary for the implementation and completion of Project STP-EN-1900(16), Enhancement of the Andrew Jackson Aquifer, which documents shall be come binding on The Metropolitan Government upon authorization and approval by resolution of the Metropolitan County Council.
SECTION 3: Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.
SECTION 4. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government requiring it.
