ORDINANCE NO. O99-1651
An ordinance approving an agreement relating to streambank stabilization in Shelby Bottoms between the Federal Government, Department of the Army, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation, and approving matching funds not to exceed $525,000.
WHEREAS, Pursuant to the agreement (the "Agreement") attached as Exhibit A and incorporated into this Ordinance by reference, the Federal Government, Department of the Army, proposes to undertake streambank stabilization work in Shelby Bottoms (the "Project) and to fund sixty-five percent (65%) of the total cost of the Project, not to exceed one million five hundred thousand dollars ($1,500,000); and
WHEREAS, pursuant to the Agreement, the Metropolitan Government must provide matching funds not to exceed five hundred twenty-five thousand dollars ($525,000) for the Project; and
WHEREAS, acceptance of the Agreement and provision of the matching funds described in the Agreement will help to enhance the entertainment and recreational opportunities for Nashvilles citizens and visitors.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. The Agreement between the Metropolitan Government of Nashville and Davidson County and the Federal Government, Department of the Army (Exhibit A) is hereby approved and the Metropolitan Mayor is authorized to execute the Agreement on behalf of the Metropolitan Government.
SECTION 2. Matching funds not to exceed five hundred twenty-five thousand dollars ($525,000) are hereby approved, to be derived from the issuance of general obligation bonds for Project No. 97PR402 (Shelby Bottoms Greenway Project).
SECTION 3. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.
SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
