ORDINANCE NO. BL2000-142
An ordinance approving a lease agreement between The Metropolitan Government of Nashville and Davidson County and Forensic Medical Management Services, P.C., to provide out-of-county autopsies to the State of Tennessee.
Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government") presently operates a medical examiner's office through a privatization contract with Forensic Medical Management Services, P.C. ("FMMS") on the former General Hospital complex at the Forensic Sciences Center; and
Whereas, the Davidson County Medical Examiner also holds the designation as the Medical Examiner of the State of Tennessee.
Whereas, the Metropolitan Government and the State of Tennessee have entered into a lease agreement for a new, state financed medical examiner facility for Davidson County and non-Davidson County autopsies that is under construction and will not be completed until some time in 2001; and
Whereas, the State of Tennessee is in need of the excess capacity of the Forensic Sciences Center for the purpose of performing non-Davidson County autopsies until the new medical examiner facility is completed; and
Whereas, FMMS is willing to perform non-Davidson County autopsies provided Metro allows FMMS to use the Forensic Sciences Center; and
Whereas, the Metropolitan Government desires to accommodate the State of Tennessee's needs and FMMS' desire to meet the needs of the State of Tennessee for non-Davidson County autopsies by leasing the excess capacity of the Forensic Sciences Center to FMMS as set forth in the attached lease agreement.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The lease between the Metropolitan Government and FMMS, which is attached hereto and incorporated by reference, is hereby approved and the Metropolitan County Mayor is authorized to execute the lease on behalf of the Metropolitan Government.
Section 2. Any further amendment to the lease between the Metropolitan Government and FMMS must be approved by resolution of the Metropolitan Council that receives at least 21 affirmative votes.
Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County
