ORDINANCE NO. BL2000-320
An Ordinance amending Section 7.16.030.C. of the Metropolitan Code by adding a portion of Stewarts Ferry Pike to the list of streets, roads or avenues that a retail liquor store may front or abut and therefore continue to operate, provided the location held a valid certificate of compliance and license to sell liquor at retail on October 5, 1990, when Metropolitan Ordinance No. O90-1339 became effective.
WHEREAS, Metropolitan Codes Subsection 7.16.030.A.3. does require that retail liquor stores be located within a major commercial concentration having a land area of ten or more contiguous commercially developed acres; and
WHEREAS, a retail sale of liquor fronting or abutting Stewarts Ferry Pike, between Lauer Drive and Hickory Bend Drive, had been continuously granted a certificate of compliance and a license to sell liquor at retail for over eleven years; and
WHEREAS, on May 25, 2000, the owner of a retail liquor store fronting or abutting Stewarts Ferry Pike, between Lauer Drive and Hickory Bend Drive, was denied a certificate of compliance because the store is not located on ten contiguous developed commercially zoned acres, but only seven contiguous developed commercially zoned acres.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That Metropolitan Code Section 7.16.030.C. is amended by adding the following new sub-subsection 3:
Stewarts Ferry Pike between Lauer Drive and Hickory Bend Drive.
SECTION 2. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
