ORDINANCE NO. BL2000-365
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by amending various sections to establish provisions for a Neighborhood Landmark District and Neighborhood Landmark Development Plan (2000Z-022T), all of which is more particularly described herein.
WHEREAS, it is recognized that historical, cultural, architectural, civic, neighborhood, or archaeological features have value and importance within neighborhoods in Nashville and Davidson County;
WHEREAS, it is recognized that the demolition or destruction of these features would constitute an irreplaceable loss to the quality and character of a neighborhood within Nashville and Davidson County;
WHEREAS, it is recognized that these features serve to distinguish one neighborhood from another within Nashville and Davidson County; and,
WHEREAS, it is recognized that protecting these features and permitting a reasonable use of a property serves to stablize and improve property value and foster civic beauty.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended as follows on Exhibit A.
SECTION 2. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
Ordinance No. BL2000-365
I move to amend Ordinance No. BL2000-365 by modifying it as follows:
To insert a new provision “Cancellation” as Section 17.40.160.A.12
In the event a building permit and/or certificate of use and occupancy has not been issued for a feature within two years from and after the date on which the metropolitan planning commission approved the Neighborhood Landmark Development Plan, the metropolitan planning commission may act to cancel a neighborhood landmark district at any time thereafter, upon giving notice to the property owner 21 days prior to the commission public hearing where the cancellation shall be considered, and in accordance with Article III ( Amendments to the Zoning Code or Official Zoning Map) XV (Public Notification) of this Title. The metropolitan council shall hold a public hearing on such cancellation in accordance with Articles III and XV of this Title, and shall concur with a cancellation before the neighborhood landmark district is removed from the official property maps of the Metropolitan Nashville and Davidson County.

I move to amend Ordinance No. BL2000-365 by amending Section 1 by amending Exhibit A by deleting the following sentence contained in 17.40.160 B.:
“In approving an ordinance establishing a Neighborhood Landmark district, the metropolitan council shall also find that the feature complies with the Criteria for Consideration.”
