ORDINANCE NO. BL2002-1192
An ordinance authorizing the Metropolitan Police Department to donate police canines and horses to qualified officers, law enforcement agencies, and/or not-for-profit organizations.
WHEREAS, the Metropolitan Police Department is in possession of police canines and horses which are untrainable, retired, otherwise unfit or unsuited for law enforcement use by the Metropolitan Police Department; and
WHEREAS, the canines in possession of the Metropolitan Police Department are trained for law enforcement purposes and are potentially dangerous and unsuited for sale or release to the general public; and
WHEREAS, the canines in possession of the Metropolitan Police Department may be suitable for use by other law enforcement or certain not-for-profit agencies, or may be suitably cared for and controlled by Metropolitan police officers or other law enforcement officers trained to handle such animals; and
WHEREAS, certain horses in possession of the Metropolitan Police Department are not trainable or otherwise suitable for use by the Police Department or other Metropolitan agencies, or for sale to the public; and
WHEREAS, certain not-for-profit agencies, other law enforcement agencies, or individuals, are qualified, able, and willing to house and care for horses possessed by the Metropolitan Government but unsuited for use by the Police Department or other Metropolitan agencies, or for sale to the public.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Chief of Police is hereby authorized to donate horses deemed unfit, in his discretion, for use by the Metropolitan Government and not suited for sale to the public, to other law enforcement agencies able to care for and use these animals and/or to not-for-profit organizations or individuals willing and able to care for and control these animals.
Section 2. That the Chief
of Police is hereby authorized to donate police canines deemed unsuited or unfit,
in his discretion, for use by the Metropolitan Government and not suited for
sale to the public, to not-for-profit organizations, law enforcement agencies
or officers qualified, trained, and willing to care for and control these animals.
Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
