ORDINANCE NO. BL2002-956
An ordinance to amend the Lenox Village Urban Design Overlay District design guidelines appendix, all of which is more particularly described herein (Proposal No. 2002Z-003T).
WHERAS Title 17 of the Metropolitan Code of Laws allows certain standards that apply to zoning districts to be varied from by design guidelines adopted simultaneously with the application of an urban design overlay district; and
WHEREAS the Lenox Village Urban Design Overlay District was applied by BL2001-671 to property along the east margin of Nolensville Pike, opposite Bradford Hills Drive; and
WHEREAS the design guidelines adopted simultaneously with the application of the Lenox Village Urban Design Overlay District have been found to contain certain inconsistencies that need to be corrected.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended as follows:
Appendix Page 2 of 5, Table A-1, Minimum Side Yard Setback for Building Type IV is changed from "5 ft." to "End units: 5 ft.*" and for Building Types V and VI is changed from "5 ft." to "3 ft.".
Add the following note to Table A-1: "*See Table A-2 on Page 3 of 5 for maximum number of units per building".
SECTION 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the changes to be made on Appendix Page 2 of 5 of the Lenox Village Urban Design Guidelines as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance as Amendment 1 to the Lenox Village Urban Design Guidelines.
SECTION 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
