ORDINANCE NO. BL2004-240
An ordinance authorizing the abandonment of the existing 8” sanitary sewer line and easement located on Map 72-3, Parcel 175 of Project No. 03-SG-193, 3518 Gallatin Pike (Proposal No. 2003M-128U-05), by the Metropolitan government.
WHEREAS, First Tennessee Bank, N.A., is the owner of real property encumbered by a Sanitary Sewer; and,
WHEREAS, portions of the existing Sanitary Sewer and Easement, on the map for Project No. 03-SG-193, 3518 Gallatin Pike, on record in the office of the Director of Water and Sewerage Services, and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility: and,
WHEREAS, the Department of Water and Sewerage Services now has no need for the portion of the said easement; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation, Proposal No. 2003M-128U-05, dated 12/11/03 of said Sanitary Sewer and Easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That 172 linear feet of the Sanitary Sewer and Easement shown on Map 72-3, Parcel 175, and shown on Project No. 03-SG-193 and on attached exhibit 1, 3518 Gallatin Pike, is abandoned by Metropolitan Government. Either or both Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
