ORDINANCE NO. BL2007-107
An ordinance authorizing the Metropolitan Government to participate with Turnberry Homes to provide public sewer service in Davidson and Williamson County to Catalina Phase 1, Project No. 07-SL-6.
WHEREAS, Turnberry Homes has expressed a desire to provide public sewer service in Davidson and Williamson County, Tennessee, to a development known as Catalina Phase 1, Project No. 07-SL-6; and
WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerages, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and
WHEREAS, This project is deemed to benefit both parties and the general community, and Turnberry Homes agrees to pay an amount not to exceed $76,000.00, for a total of 38 single-family home connections.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
SECTION 1. The participation agreement with Turnberry Homes, to provide public sewer services in Davidson and Williamson County, Tennessee, to a development known as Catalina Phase 1, Project No. 07-SL-6, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.
SECTION 2. That the $76,000.00 from Centex Homes will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of 38 single-family home connections.
SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
