ORDINANCE NO. BL2008-304An ordinance granting an easement to Lion Oil Company at Van Buren Street in Davidson County for the relocation of an underground fuel delivery pipeline (Proposal No. 2008M-145U-8).
WHEREAS, Lion Oil Company operates fuel storage and distribution facilities on Van Buren Street in Nashville; and
WHEREAS, pursuant to BL 2007-1392, the Metropolitan Government accepted and recorded an easement from Lion Oil Company on its Van Buren Street property for use in constructing the Cumberland River greenway; and
WHEREAS, Lion Oil’s Van Buren Street facilities are connected by underground pipeline (the “Pipeline”) to a Cumberland River terminal used as a backup means of fuel delivery; and
WHEREAS, a portion of the Pipeline located on property belonging to the Metropolitan Government had to be moved in connection with construction of the new biosolids facility on the campus of the Metropolitan Department of Water and Sewerage Services; and
WHEREAS, pursuant to the terms of the document attached as Exhibit A and incorporated into this ordinance, the Metropolitan Government proposes to grant an easement to Lion Oil Company for relocation of the Pipeline.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The grant of easement described in Exhibit A is hereby approved, and the director of public property or his designee is authorized to execute the easement on behalf of the Metropolitan Government.
Section 2: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
