ORDINANCE NO. BL2009-465
An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Chapters 17.08, 17.36 and 17.40 to create a new Mobile Vendor Overlay (MVO) district, all of which is more specifically described herein (Proposal No. 2009Z-011TX-001 ).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Chapter 17.36 by adding the following new Article XIII.
Article XIII. Mobile Vendor Overlay District
17.36.450 Purpose and intent.
The purpose of the mobile vendor overlay district is to provide a means by which mobile vendors that do not qualify for a conditional permit under Section 17.16.070.M. of this Title can engage in mobile vending activity in certain areas of Nashville and Davidson County.
A. Mobile vendors that do not meet the conditional permit requirements of Section 17.16.070.M. of this Title shall be eligible to engage in mobile vending activity within the boundaries of a mobile vendor overlay district approved by the metropolitan council.
B. Setback. All mobile vending activity shall be setback a minimum of fifty feet from the public right-of-way. Further, all such mobile vending activity shall be setback at least fifty feet from any residential zoning district.
C. Street Standard. Mobile vending activity shall not be permitted along any local residential street or arterial street, but shall only take place when frontage is on a collector street.
D. Outdoor Loudspeakers. There shall be no outdoor loudspeakers or public address systems.
E. Hours of Operation. The hours of operation for any mobile vending activity shall be limited to 7:00 a.m. to 6:00 p.m.
Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
