ORDINANCE NO. BL2011-875
An ordinance to abandon 110 feet of an 8 inch sanitary sewer line, Project 10-SL-227, and accept a fire hydrant assembly, Project 10-WL-112, on property located at 420 Donelson Pike, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-034ES-001).
WHEREAS, 110 feet of an 8 inch sanitary sewer line, Project 10-SL-227, is no longer being used by the Department of Water and Sewerage Services nor any other public utility, and a fire hydrant assembly, Project 10-WL-112, has been constructed and is ready for acceptance, both of which are on record in the department of Water and Sewerage Services and incorporated herein by reference; and,
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2010M-034ES-001 on January 24, 2011, for abandonment and acceptance of said easement, sanitary sewer line and fire hydrant assembly.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Government hereby abandons the 110 feet of an 8 inch sanitary sewer line, Project 10-SL-227, and accepts a fire hydrant assembly, Project 10-WL-112, on property located at 420 Donelson Pike, as indicated on Exhibit 1 hereto.
Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and relocation authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
