ORDINANCE NO. BL2013-512
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Old Matthews Road Stormwater Improvement Project on eight (8) properties located along OLD Matthews Road, Brick Church Pike, and Gwynnwood Road. (Project No.13-SWC-155 and Proposal No. 2013M-031ES-001).
WHEREAS, the negotiation and acceptance of permanent and temporary easements for eight (08) properties located along Old Matthews Road, Brick Church Pike, and Gwynnwood Road are needed to construct Stormwater Project 13-SWC-155 (Proposal No. 2013-031ES-001); and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-031ES-001 on June 11, 2013, for the negotiation and acceptance of permanent and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements on eight (8) properties located along Old Matthews Road, Brick Church Pike, and Gwynnwood Road, as shown on Exhibit 1, attached hereto and incorporated by reference.
Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
