ORDINANCE NO. BL2016-421
An ordinance approving an agreement for the acquisition of a parcel of property, an agreement for the disposition of that parcel of property, and an easement agreement, all relating to construction of a pedestrian bridge spanning the railroad gulch in downtown Nashville (Proposal No. 2016M-027PR-001).
WHEREAS, pursuant to the terms of the document attached as Exhibit 1 (the “MTA Agreement”), the Metropolitan Government proposes to acquire a certain tract of real property (the “LandPort Property”) from the Nashville Metropolitan Transit Authority; and,
WHEREAS, pursuant to the terms of the document attached as Exhibit 2 (the “CS Agreement”), the Metropolitan Government proposes to sell the LandPort Property to Cummins Station, LLC; and,
WHEREAS, pursuant to the terms of the document attached as Exhibit 3 (the “Easement Agreement”), the Metropolitan Government proposes to acquire an easement from Cummins Station, LLC, necessary for construction of a pedestrian bridge spanning the railroad gulch in downtown Nashville; and,
WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the agreements described herein.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The MTA Agreement (Exhibit 1) is hereby approved.
Section 2. The CS Agreement (Exhibit 2) is hereby approved.
Section 3. The Easement Agreement (Exhibit 3) is hereby approved.
Section 4. The Metropolitan Mayor or her designee is authorized to execute such documents as are necessary to carry out the property conveyances contemplated herein.
Section 5. Amendments to any of the agreements approved by this ordinance may be authorized by resolution of the Metropolitan Council.
Section 6. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
