RESOLUTION NO. RS2000-373
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to increase the penalty for T.C.A. Section 39-14-202 (Cruelty to Animals) from a misdemeanor to a felony.
WHEREAS, currently, T.C.A. Section 39-14-202 (Cruelty to Animals) provides that persons who commit the offense of torturing or maiming animals are punished as a Class A misdemeanor which provides for a jail sentence of up to eleven (11) months and twenty-nine (29) days and a fine of up to $2,500; and
WHEREAS, the Metropolitan County Council believes that the penalty for such actions should be that of a felony which could require a punishment of from one (1) to six (6) years in prison.
NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to increase the penalty for T.C.A. Section 39-14-202 (Cruelty to Animals) from a misdemeanor to a felony.
SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation.
SECTION 3. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
