RESOLUTION NO. RS2000-428

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Lindsey P. Bowen against The Metropolitan Government of Nashville and Davidson County for $6,286.42 and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on August 19, 2000, Lindsey P. Bowen was with her mother when she sustained a fracture to her little toe while sliding down a defective slide on the playground area at the Wave Pool managed by Ricky Biggs, an employee of the Metropolitan Department of Parks and Recreation; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Lindsey P. Bowen for the amount of $6,286.42 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
