RESOLUTION NO. RS2001-574
A resolution approving a contract for wood waste processing and disposal between The Metropolitan Government of Nashville and Davidson County and Jackson White d/b/a Environmental Wood Recycling.
Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government") and Jackson White d/b/a Environmental Wood Recycling propose to enter into a contract for the processing and disposal of wood waste in accordance with the terms of the document (the "Contract") attached as Exhibit A to this resolution; and
Whereas, the services contemplated by the Contract were performed by Metropolitan Government personnel prior to September 1, 1995; and
Whereas, the cost of the services contemplated by the Contract is expected to exceed one hundred thousand dollars annually; and
Whereas, Section 4.12.095 of the Metropolitan Code of Laws requires that any contract calling for the performance by a private contractor of functions performed as of September 1, 1995 by Metropolitan Government employees, and expected to cost one hundred thousand dollars or more annually, be approved by resolution of the Metropolitan Council adopted by twenty-one affirmative votes; and
Whereas, approval of the Contract will benefit the citizens of Metropolitan Nashville and Davidson County.
Now, therefore, be it resolved by the Metropolitan Council:
Section 1. The Contract with Jackson White d/b/a Environmental Wood Recycling (Exhibit A) is approved and the Metropolitan Mayor is authorized to execute it.
Section 2. Any amendment to the Contract may be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.
Section 3. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
