RESOLUTION NO. RS2010-1225
A resolution recognizing the continuing status of the area within the City of Lakewood as being part of the General Services District of the Metropolitan Government and memorializing the Metropolitan Council’s intent not to annex the area into the Urban Services District in the event the City of Lakewood surrenders its Charter.
WHEREAS, on April 13, 2010, citizens of Lakewood filed a Petition for Referendum with the Davidson County Election Commission to have a question placed on the ballot concerning whether the City of Lakewood should be dissolved; and
WHEREAS, if the petition is certified by the Election Commission, the question will be placed on the ballot for the August 5, 2010, election; and
WHEREAS, pursuant to Section 18.15 of the Metropolitan Charter, if Lakewood surrenders its City Manager-Commission Charter, the status of the City shall remain that of the other areas outside the Urban Services District of the Metropolitan Government unless the Metropolitan Council adopts a resolution to the contrary prior to such surrender; and
WHEREAS, if the voters of the City of Lakewood decide to surrender its Charter, the Metropolitan Council has no intention to annex any portion of the property currently situated within the boundaries of the City of Lakewood into the Urban Services District during this Council term.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. In the event the voters of the City of Lakewood decide to surrender its City Manager-Commission Charter, the Metropolitan County Council hereby expresses its intent that the former City of Lakewood shall continue as part of the General Services District and will not be annexed into the Urban Services District pursuant to Section 1.04 of the Metropolitan Charter, at least through August 30, 2012.
Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
