Metropolitan Council Meeting, July 3, 2018

Call to Order and Invocation

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Dr. Kelly Miller Smith, Jr. of First Baptist Church, Capitol Hill.

Pledge of Allegiance

​The Metropolitan Council gave the pledge of allegiance to the American Flag.

Approval of Minutes

The minutes of the regular meeting on June 19, 2018 were approved.

Employee Benefit Board

Reappointment of Dr. Christine Bradley for a term expiring June 30, 2021.

The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Council Member Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board

Reappointment of Mr. Tandy Wilson for a term expiring May 17, 2023.

The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Council Member Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Codes Appeals Board

Reappointment of Mr. John Finch for a term expiring March 1, 2022.

The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Council Member Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Hospital Authority

Appointment of Dr. Loretta Bond for a term expiring July 11, 2019.
Dr. Bond will fill the unexpired term of Dr. Fredia Outlaw.
Appointment of Dr. Shindana Feagins for a term expiring July 11, 2021.
Dr. Feagins will fill the unexpired term of Dr. Michele Williams.
Appointment of Ms. Alexandria Scarbrough Fisher for a term expiring September 6, 2021.
Ms. Fisher will fill the unexpired term of Mr. Harry Allen.
Reappointment of Mr. Joel Sullivan for a term expiring July 11, 2023.

The Rules, Confirmations, and Public Elections Committee recommended the appointments and reappointment. Council Member Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Tourism and Convention Commission

Reappointment of Mr. Fletcher Foster for a term expiring June 30, 2021.
Reappointment of Ms. Leesa LeClaire for a term expiring June 30, 2021.
Reappointment of Mr. Hank Locklin for a term expiring June 30, 2021.

The Rules, Confirmations, and Public Elections Committee recommended the reappointments. Council Member Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Resolutions on Public Hearing

Resolution RS2018-1266

A resolution exempting Los Churrascos located at 2500 Murfreesboro Pike from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E of the Metropolitan Code.

The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. Council Member Karen Johnson requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. Resolution RS2018-1267

A resolution exempting Pelican and Pig located at 1010 Gallatin Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E of the Metropolitan Code.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUG zoning on property located at 261 French Landing Drive, approximately 535 feet southeast of Athens Way (3.06 acres), all of which is described herein (Proposal No. 2018Z-018PR-001).

Bill BL2018-1169

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a specific plan on property located at 2209 Abbott Martin Road, at the southwest corner of Abbott Martin Road and Hillsboro Circle, zoned SP and within the Green Hills Urban Design Overlay District (2.08 acres), to permit multi-family residential and various non-residential uses, all of which is described herein (Proposal No. 2010SP-003-003).

The bill was approved with conditions, disapproved without by the Planning Commission. Council Member Pulley requested a hearing from the public on this bill which had been previously advertised. Council Member Pulley moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council with Council Member Shulman abstaining.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning on property located at 12452 Old Hickory Boulevard, approximately 1,200 feet east of Murfreesboro Pike, within the Murfreesboro Pike Urban Design Overlay District (6.03 acres), to permit up to 53 multi-family residential dwelling units, all of which is described herein (Proposal No. 2018SP-006-001).

The bill was disapproved by the Planning Commission. Council Member Karen Johnson requested a hearing from the public on this bill which had been previously advertised. Bill BL2018-1183

An ordinance amending Chapter 17.16 of the Metropolitan Zoning Code to add conditions to the uses of automobile repair and automobile sales, used. (Proposal No. 2018Z-003TX-001).

The bill was referred to the Planning Commission. Council Member Freeman moved to defer the bill to the October 2, 2018 public hearing, which motion was seconded and approved by a voice vote of the Council.

Bill BL2018-1195

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR and RS5 to SP zoning on properties located at 1003, 1011, 1013 and 1013 B 44th Avenue North and 44th Avenue North (unnumbered), approximately 625 feet south of Centennial Boulevard (1.96 acres), to permit a maximum of 37 multi-family residential units, all of which is described herein (Proposal No. 2018SP-011-001).

The bill was approved with conditions, disapproved without all conditions by the Planning Commission. Council Member Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to the bill. The President declared the public hearing closed. Council Member Kindall moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

Bill BL2018-1197

An ordinance approving the plans for a Construction and Demolition solid waste processing facility to be located at 4648 Ashland City Highway, Nashville, TN 37218.

Council Member Cooper requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of the bill. The President declared the public hearing closed. Council Member Cooper offered a substitute ordinance and moved that it be accepted for filing, which motion was properly seconded. Council Member Allen moved to suspend the Rules of Procedure for consideration of a late amendment. The Rules, Confirmations, and Public Elections Committee had no objection to consideration of the amendment. Council Member Allen moved that Amendment No. 1 be incorporated with the substitute, which motion was seconded and approved by a voice vote of the Council. Council Member Gilmore moved to suspend Rule 32 of the Council Rules of Procedure to offer a motion to hold a subsequent public hearing on the bill on third and final reading. The motion was met with requisite objection to cause the motion to fail. Without objection, the President reopened the public hearing to permit Mr. Jonathan Hall (confirmation as District 1 Council Member pending) to be heard regarding procedural matters pertinent to the bill. The President declared the public hearing closed. Council Member Sledge called for the previous question, which motion was approved by a voice vote of the Council. The matter recurred on the motion to adopt the substitute as amended, which motion was seconded and approved by a voice vote of the Council.

An ordinance approving the plans for a solid waste processing facility to be located at 4648 Ashland City Highway, Nashville, TN 37218.

The bill was approved by the Public Works Committee. Council Member Cooper moved to pass the bill on second reading, and to re-refer the bill to the Public Works Committee, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to RS40 zoning for various properties located on Granny White Pike, Camelot Court, Camelot Road, and Lancelot Road, east of Granny White Pike (50.25 acres), all of which is described herein (Proposal No. 2018Z-059PR-001).
