Bill BL2019-1483

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, storm sewer main, sanitary sewer manholes and easements and to accept new sanitary sewer and water mains, sanitary sewer manholes, a fire hydrant assembly and easements for properties located at 151 1st Avenue South and 150 2nd Avenue South (MWS Project No. 18-WL-114 and 18-SL-145 and Proposal No. 2019M-004ES-001).

WHEREAS, the abandonment of approximately 345 linear feet of existing eight inch sanitary sewer main, approximately 575 linear feet of existing storm sewer main, two sanitary sewer manholes and easements, and the acceptance of approximately 232 linear feet of new 18 inch sanitary sewer main (PVC), approximately 22 linear feet of new 15 inch sanitary sewer main (PVC), approximately 35 linear feet of new eight inch water main (DIP), two sanitary sewer manholes, one fire hydrant assembly and easements, for properties located at 151 1st Avenue South and 150 2nd Avenue South, are needed to construct project numbers 18-WL-114 and 18 SL-145; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 004ES-001, on December 4, 2018, for the abandonment and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, a fire hydrant assembly and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 345 linear feet of existing eight inch sanitary sewer main, approximately 575 linear feet of existing storm sewer main, two sanitary sewer manholes and easements, and to accept approximately 232 linear feet of new 18 inch sanitary sewer main (PVC), approximately 22 linear feet of new 15 inch sanitary sewer main (PVC), approximately 35 linear feet of new eight inch water main (DIP), two sanitary sewer manholes, one fire hydrant assembly and easements, for properties located on 151 1st Avenue South and 150 2nd Avenue South, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
