Bill BL2018-1104

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water mains, sewer mains and easements and to accept new water mains, sewer mains, sewer manholes, fire hydrants and any associated easements, for properties located along Commerce Street, Broadway, and Church Street (MWS Project Nos. 17-WL-178 and 17-SL-191 and Proposal No. 2018M-007ES-001).

WHEREAS, the abandonment of approximately 30 linear feet of existing 12 inch water main, approximately 465 linear feet of existing 10 inch water main, approximately 652 linear feet of existing eight inch water main, approximately 1,685 linear feet of existing six inch water main, approximately 264 linear feet of existing three inch water main, approximately 475 linear feet of existing 30 inch sewer main, approximately 696 linear feet of existing 24 inch sewer main, approximately 519 linear feet of existing 18 inch sewer main, approximately 454 linear feet of existing 12 inch sewer main, approximately 326 linear feet of existing 10 inch sewer main, approximately 154 linear feet of existing eight inch sewer main and easements, and the acceptance of approximately 23 linear feet of new 12 inch water main, approximately 2,192 linear feet of new 10 inch water main, approximately 1,115 linear feet of new eight inch water main, approximately 475 linear feet of new 60 inch sewer main, approximately 166 linear feet of new 30 inch sewer main (DIP), approximately 22 linear feet of new 30 inch sewer main (RCP), approximately 172 linear feet of new 24 inch sewer main, approximately 313 linear feet of new 18 inch sewer main, approximately 442 linear feet of new 12 inch sewer main (PVC), approximately 42 linear feet of new 12 inch sewer main (DIP), 15 sewer manholes, seven fire hydrants and any associated easements, for properties located along Commerce Street, Broadway, and Church Street, are needed to construct project numbers 17 WL-178 and 17 SL 191; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2018M 007ES-001 on January 22, 2018, for the abandonment and acceptance of said water mains, sewer mains, sewer manholes, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 30 linear feet of existing 12 inch water main, approximately 465 linear feet of existing 10 inch water main, approximately 652 linear feet of existing eight inch water main, approximately 1,685 linear feet of existing six inch water main, approximately 264 linear feet of existing three inch water main, approximately 475 linear feet of existing 30 inch sewer main, approximately 696 linear feet of existing 24 inch sewer main, approximately 519 linear feet of existing 18 inch sewer main, approximately 454 linear feet of existing 12 inch sewer main, approximately 326 linear feet of existing 10 inch sewer main, approximately 154 linear feet of existing eight inch sewer main and easements, and to accept approximately 23 linear feet of new 12 inch water main, approximately 2,192 linear feet of new 10 inch water main, approximately 1,115 linear feet of new eight inch water main, approximately 475 linear feet of new 60 inch sewer main, approximately 166 linear feet of new 30 inch sewer main (DIP), approximately 22 linear feet of new 30 inch sewer main (RCP), approximately 172 linear feet of new 24 inch sewer main, approximately 313 linear feet of new 18 inch sewer main, approximately 442 linear feet of new 12 inch sewer main (PVC), approximately 42 linear feet of new 12 inch sewer main (DIP), 15 sewer manholes, seven fire hydrants and any associated easements, for properties located along Commerce Street, Broadway, and Church Street, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
