Bill BL2018-1321

An ordinance disclaiming any interest the Metropolitan Government may have in the Nashville-Gallatin Interurban Railroad right-of-way (Proposal No. 2018M-021AB-001).

WHEREAS, the Nashville-Gallatin Interurban Railroad, an electric commuter rail line, operated from 1913 until 1932 between Nashville and Gallatin; and,

WHEREAS, a survey conducted of 1100 Eastdale Ave revealed remaining railroad right-of-way on the property; and,

WHEREAS, the owner of the property, TBC Development, LLC, has requested that Metro disclaim any interest it may have in the right-of-way; and,

WHEREAS, there is no future need for said right-of-way for The Metropolitan Government of Nashville and Davidson County purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Metropolitan Government of Nashville and Davidson County does hereby abandon the claim if any, to the Nashville – Gallatin Interurban Railroad right-of-way, crossing a portion of Lot 122 Eastdale Place Subdivision, referenced in Deed Book 1316, Page 612, R.O.D.C. TN. Said property is also known as Tax Map 061-11, parcel 189.00. This abandonment does not include any portion of Gallatin Pike or Eastdale Place right-of-way.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
