Bill BL2020-341

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Big Horn Drive Stormwater Improvement Project for three properties located at 4881, 4885 and 4889 Big Horn Drive (Project No. 20-SWC-173 and Proposal No. 2020M-055ES-001).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for three properties located at 4881, 4885 and 4889 Big Horn Drive are needed to construct MWS Project 20-SWC-173; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M 055ES-001 on June 9, 2020, for the negotiation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for three properties located along Big Horn Drive as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
