Bill BL2019-1550

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer and water mains, a sanitary sewer manhole, a fire hydrant assembly and easements and to accept new water and sanitary sewer mains, sanitary sewer manholes, fire hydrant assemblies and easements for properties located along Belmont Boulevard, Bernard Avenue and Compton Avenue (MWS Project Nos. 18-WL-109 and 18-SL-135 and Proposal No. 2019M-010ES-001).

WHEREAS, the abandonment of approximately 462 linear feet of existing eight inch sanitary sewer main, approximately 498 linear feet of existing 16 inch water main, approximately 373 linear feet of existing 12 inch water main, approximately 901 linear feet of existing six inch water main, one sanitary sewer manhole, one fire hydrant assembly and easements, and the acceptance of approximately 375 linear feet of new eight inch sanitary sewer main (PVC), approximately 1,294 linear feet of new 16 inch water main (DIP), approximately 64 linear feet of new 10 inch water main (DIP), five sanitary sewer manholes, two fire hydrant assemblies and easements, for properties located along Belmont Boulevard, Bernard Avenue and Compton Avenue, are needed to construct project numbers 18-WL-109 and 18-SL-135; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 010ES-001 on February 12, 2019, for the abandonment and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 462 linear feet of existing eight inch sanitary sewer main, approximately 498 linear feet of existing 16 inch water main, approximately 373 linear feet of existing 12 inch water main, approximately 901 linear feet of existing six inch water main, one sanitary sewer manhole, one fire hydrant assembly and easements, and to accept approximately 375 linear feet of new eight inch sanitary sewer main (PVC), approximately 1,294 linear feet of new 16 inch water main (DIP), approximately 64 linear feet of new 10 inch water main (DIP), five sanitary sewer manholes, two fire hydrant assemblies and easements, for properties located along Belmont Boulevard, Bernard Avenue and Compton Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
