Bill BL2019-97

An ordinance approving and authorizing the Director of Public Property Administration, or his designee, to accept of donation of real property including an existing water pumping station, and the surrounding pump house building, located at Oakwood Avenue (unnumbered) for Metro Water Services (Map and Parcel No. 072-05-0184.00 and Proposal No. 2019M-023PR-001).

WHEREAS, Oakwood Developer, LLC owns property in Davidson County located at Oakwood Avenue (unnumbered) (the “Property”), described in Exhibit 1, attached hereto, that houses a public water pump system; and,

WHEREAS, the parcel was created by Plat #20190211-0012586, R.O.D.C., Tennessee, with the intention of being deeded over to The Metropolitan Government of Nashville and Davidson County for control and ownership of the property and infrastructure; and,

WHEREAS, Oakwood Developer, LLC propose to donate the Property to the Metropolitan Government of Nashville and Davidson County (“Metropolitan Government”); and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 023PR-001 on October 25, 2019, for the acceptance of donation of Property, contingent on the completion and verification of said pumping station, followed by the abandonment of the water pumping station located at 2124 Oakwood Avenue (Map and Parcel No. 071-04-0255.00); and,

WHEREAS, Metro Water Services recommends acceptance of the donation of the Property; and,

WHEREAS, acceptance of the donation of the Property will benefit the citizens of Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration, or designee, is hereby authorized to execute such documents as may be necessary to effectuate the donation of the Property described in Exhibit 1, attached hereto, from Oakwood Developer, LLC to the Metropolitan Government, contingent on the completion and verification of said water pumping station, followed by the abandonment of the water pumping station located at 2124 Oakwood Avenue (Map and Parcel No. 071-04-0255.00), as shown below and on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the donation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
