Bill BL2018-1144

An ordinance authorizing the granting of temporary and permanent easements to the State of Tennessee, Department of Transportation (hereinafter “TDOT”) on certain properties owned by the Metropolitan Government (Proposal No. 2018M-027ES-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County owns certain properties along Clarksville Highway; and,

WHEREAS, TDOT has requested temporary and permanent easements, as described in the attached Easement Agreement and shown on Exhibit A, across said properties for a widening project related to work along Clarksville Highway; and,

WHEREAS, the granting of such temporary and permanent easements is necessary for the successful construction of a widening project along Clarksville Highway (Parcel Nos. 06916001000, 06900010300, 06908000100, 06900022800, 06904023600, 06904023700, 06904023800, and 06904023900).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The granting of the following permanent and temporary easements to TDOT for the purpose of constructing and maintaining a widening project along Clarksville Highway (as described in the attached Easement Agreement and shown in attached Exhibit A) are hereby approved.

Section 2. That the Director of Public Property Administration is hereby authorized to grant said easement and to execute the necessary documents pertaining thereto.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
