Bill BL2020-153 (as amended)

An ordinance establishing a new fee structure for sidewalk waivers.

WHEREAS, individuals are authorized to file an application for a sidewalk waiver with the Zoning Administrator pursuant to Section 17.20.120.A.3 of the Metropolitan Code of Laws; and

WHEREAS, currently, there is no fee associated with a sidewalk waiver application; and

WHEREAS, there is a significant cost to the Metropolitan Government to process each sidewalk waiver application; and

WHEREAS, based upon information received from applicable Metro departments, a fee of three hundred and sixty dollars represents a reasonable cost to the Metropolitan Government to process each sidewalk waiver application.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That a fee of three hundred sixty dollars shall accompany each application for a waiver from the sidewalk regulations requested pursuant to Section 17.20.120.A.3 of the Metropolitan Code of Laws.

Section 2. That the sidewalk waiver application fee is tripled for all waiver requests filed after issuance of the associated building permit.

Section 3. That this Ordinance shall take effect upon its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
