Bill BL2019-1656

An ordinance amending Section 6.72.245 and Section 6.74.230 of the Metropolitan Code of Laws to extend the vehicle age at which taxi cabs and other passenger vehicles of hire may be operated.

WHEREAS, with the introduction of Uber and Lyft, taxicabs and other passenger vehicles for hire have found it increasingly difficult to stay competitive in the industry; and,

WHEREAS, currently, taxicabs and other passenger vehicles for hire are limited to utilizing vehicles that are no more than 10 years old; and,

WHEREAS, in addition to the vehicle year limitation, other passenger vehicles for hire are restricted from using vehicles having more than three hundred fifty thousand miles on the odometer; and,

WHEREAS, the industry has reported to the Transportation Licensing Commission that allowing vehicles up to fifteen years old to operate would enable them to be more competitive and would reduce costs associated with replacing vehicles that are still safe and capable of performing as a vehicle for hire; and,

WHEREAS, the Transportation Licensing Commission has recommended that the vehicle age limitation be increased and that the mileage cap for other passenger vehicles for hire be removed.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 6, Section 6.72.245(A) of the Metropolitan Code of Laws shall be amended by deleting it in its entirety and replacing it with the following:

“No vehicle operated as a taxicab shall be more than fifteen years old. By the end of December 31st of each year, automobiles at the end of their fifteenth year must be taken out of service or replaced. The commission shall establish, by its rules, a procedure by which an affected vehicle owner may seek a waiver under this rule. The commission may also, by rule, provide for a waiver of this rule for classic automobiles and provide for a definition for classic automobiles.”

Section 2. That Title 6, Section 6.74.230(A), of the Metropolitan Code of Laws shall be amended by deleting it in its entirety and replacing it with the following:

“Except for a classic, vintage or unique passenger vehicle for hire, no vehicle to be operated as a passenger vehicle for hire shall be more than fifteen years old.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
