An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, sanitary sewer manholes, and easements and to accept new sanitary sewer mains, sanitary sewer manholes, and easements for property located at 801 12th Avenue South (MWS Project No. 19-SL-151 and Proposal No. 2019M-086ES-001).

WHEREAS, the abandonment of approximately 949 linear feet of existing eight inch sanitary sewer main, four sanitary sewer manholes and easements, and the acceptance of approximately 42 linear feet of new eight inch sanitary sewer main (PVC), approximately 128 linear feet of new eight inch sanitary sewer main (DIP), five sanitary sewer manholes and easements, for property located at 801 12th Avenue South, are needed to construct project number 19-SL-151; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 086ES-001 on November 27, 2019, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 949 linear feet of existing eight inch sanitary sewer main, four sanitary sewer manholes and easements, and to accept approximately 42 linear feet of new eight inch sanitary sewer main (PVC), approximately 128 linear feet of new eight inch sanitary sewer main (DIP), five sanitary sewer manholes and easements, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
