Bill BL2018-1180

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer mains and easements and to accept new sanitary sewer main, sanitary sewer manholes and easements, for properties at 425 Chestnut Street, 1201 Brown Street, and 500 and 510 Houston Street, (MWS Project No. 17-SL-157 and Proposal No. 2018M-037ES-001).

WHEREAS, the abandonment of approximately 50 linear feet of existing 15 inch sewer main, 229 linear feet of existing 12 inch sewer main, 157 linear feet of existing eight inch sewer main and easements, and the acceptance of approximately 87 linear feet of new eight inch sanitary sewer main, four sanitary sewer manholes and any easements, for properties located at 425 Chestnut Street, 1201 Brown Street, and 500 and 510 Houston Street, are needed to construct project number 17-SL-157; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2018M 037ES-001 on April 3, 2018, for the abandonment and acceptance of said sewer mains, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon 50 linear feet of existing 15 inch sewer main, 229 linear feet of existing 12 inch sewer main, 157 linear feet of existing eight inch sewer main and easements, and to accept approximately 87 linear feet of new eight inch sanitary sewer main, four sanitary sewer manholes and any easements, for properties located at 425 Chestnut Street, 1201 Brown Street, and 500 and 510 Houston Street, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
