An ordinance amending Chapter 4.12 of the Metropolitan Code to require contracts procured through an invitation to bid process to become effective no later than 30 days after the award is made.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 4.12.030 of the Metropolitan Code is hereby amended by adding the following new subsection J.:
J. All contracts procured through an invitation to bid process shall become effective and operative no later than 30 days after the final award is made, regardless of the signature of the mayor, a department head, or the chair of a board or commission. For purposes of this subsection, “final award” means the award of the contract after any applicable appeal process through the procurement appeals board has concluded.
Section 2. That this ordinance shall apply to all contracts previously awarded through an invitation to bid process that are pending at the time of enactment of this ordinance, and to all such contracts awarded after the enactment date.
Section 3. That this ordinance take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
