Bill BL2020-239

An ordinance authorizing the granting of permanent and temporary construction easements to Brand Berry Hill Apartments, LLC on a parcel or property owned by the Metropolitan Government (Proposal No. 2020M-018ES-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County owns certain real property (Metro Parcel ID 11803000800; the “Property”); and

WHEREAS, Brand Berry Hill Apartments owns another parcel of property (Metro Parcel ID 11803000600; the “Grantee Property”) with limited access to public rights of way; and

WHEREAS, Brand Berry Hill Apartments has requested permanent and temporary construction easements (the “Easements”) across the Property to provide for vehicular and pedestrian access, ingress, and egress between the Grantee Property and Bransford Ave, as shown on Exhibit A; and

WHEREAS, Brand Berry Hill Apartments has agreed to pay fair market value as compensation for the Easements; and

WHEREAS, the Board of Education has approved the granting of the Easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The granting of the following temporary construction and permanent easements to Brand Berry Hill Apartments across the MNPS tract to provide for vehicular and pedestrian access, ingress, and egress between the Grantee Tract and Bransford Ave. is hereby approved.

Section 2. The Director of Public Property Administration is authorized to execute and record the Easements and other such documents as may be necessary to carry out the objective of this ordinance.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
