An ordinance authorizing the Director of Public Property Administration, or his designee, to accept, execute and record a quitclaim deed from the State of Tennessee, acting by and through the Commissioner of Transportation, to the Department of Public Works of the Metropolitan Government of Nashville and Davidson County, for a certain easement acquired by the state to complete a bridge rehabilitation project at Hillwood Boulevard bridge over CSX Transportation railroad crossing and Richland Creek (Proposal No. 2019M-010PR-001).
Whereas, BL2018-1143 authorized an agreement between the State of Tennessee, acting through its Department of Transportation (TDOT), City of Belle Meade, CSX Transportation, and The Metropolitan Government of Nashville and Davidson County (METRO), acting by and through its Department of Public Works, for the bridge rehabilitation project at the Hillwood Boulevard bridge over CSX Transportation railroad crossing and Richland Creek, Agreement No. 0981, PIN No. 107669.00, State Project No. 19960-3521-94, Federal Project No. NHZ-9312(80), CSXT OP No: TN0327; and,
Whereas, pursuant to the agreement, METRO agreed to assume ownership and the responsibility to maintain the highway project upon completion of construction; and,
Whereas, by inadvertence, a required easement for Tract 5 of said project was conveyed to the State of Tennessee, Department of Transportation, as grantee rather than to METRO as grantee; and,
Whereas, because METRO will maintain the project, and in order to correct this mistake, the State of Tennessee, acting by its Commissioner of Transportation, wishes to execute a Quitclaim Deed for the purpose of conveying the easement acquired for said project to METRO; and,
Whereas, it is in METRO’s best interest to accept the easement.
NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Director of Public Property Administration is authorized to accept, execute and record the quitclaim deed attached hereto and incorporated herein, from the State of Tennessee, acting through the Commissioner of Transportation,
Section 2. That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
