Bill BL2019-39

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Stratford Avenue Stormwater Improvement Project for 21 properties located along Stratford Avenue, McChesney Avenue, Gallatin Pike and Katherine Street (Project No. 20-SWC-143 and Proposal No. 2019M-066ES-001).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for 21 properties located along Stratford Avenue, McChesney Avenue, Gallatin Pike and Katherine Street are needed to construct MWS Project No. 20-SWC-143; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 066ES-001 on September 18, 2019, for the negotiation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for 21 properties located along Stratford Avenue, McChesney Avenue, Gallatin Pike and Katherine Street, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
