An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water mains and fire hydrant assemblies, to accept new water mains and fire hydrant assemblies, and to acquire easements through negotiation, condemnation and acceptance for the 12th Avenue South Water Main Improvement Project Phases 2 & 3 for various properties between Belmont Boulevard and 12th Avenue South along 12th Avenue South, Kirkwood Avenue, Sherbourne Avenue, 9th Avenue South, Craig Avenue, Lealand Lane, and Gale Lane (MWS Project No. 17-WC-62 and Proposal No. 2019M-045ES-001).

WHEREAS, the abandonment of approximately 11,498 linear feet of existing six inch water main, approximately 196 linear feet of existing four inch water main, approximately 324 linear feet of existing three inch water main, approximately 482 linear feet of existing two inch water main, approximately 544 linear feet of existing two and a quarter inch water main and 21 fire hydrant assemblies, and the acceptance of approximately 20 linear feet of new 12 inch water main (DIP), approximately 15,840 linear feet of new eight inch water main (DIP), approximately 600 linear feet of new six inch water main (DIP), approximately 40 linear feet of new four inch water main (DIP), and 21 fire hydrant assemblies, as well as the negotiation, condemnation and acceptance of easements, for various properties between Belmont Boulevard and 12th Avenue South, along 12th Avenue South, Kirkwood Avenue, Sherbourne Avenue, 9th Avenue South, Craig Avenue, Lealand Lane, and Gale Lane, are needed to construct project number No. 17 WC-62; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 045ES-001 on May 24, 2019, for the abandonment and acceptance of said water mains, and fire hydrant assemblies, and for the acquisition through negotiation, condemnation and acceptance of easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 11,498 linear feet of existing six inch water main, approximately 196 linear feet of existing four inch water main, approximately 324 linear feet of existing three inch water main, approximately 482 linear feet of existing two inch water main, approximately 544 linear feet of existing two and a quarter inch water main and 21 fire hydrant assemblies, and to accept approximately 20 linear feet of new 12 inch water main (DIP), approximately 15,840 linear feet of new eight inch water main (DIP), approximately 600 linear feet of new six inch water main (DIP) and approximately 40 linear feet of new four inch water main (DIP), and 21 fire hydrant assemblies, as well as to to negotiate, condemn and accept easements for various properties between Belmont Boulevard and 12th Avenue South, along 12th Avenue South, Kirkwood Avenue, Sherbourne Avenue, 9th Avenue South, Craig Avenue, Lealand Lane, and Gale Lane, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, acceptance, and negotiations, condemnation and acceptance of easements authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
