Bill BL2019-1712

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, a sanitary sewer manhole and easements and to accept new sanitary sewer main, sanitary sewer manholes and easements, for six properties located on Compton Avenue, Belmont Boulevard and Delmar Avenue (MWS Project No. 19-SL-21 and Proposal No. 2019M-043ES-001).

WHEREAS, the abandonment of approximately 363 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole, and easements, and the acceptance of approximately 278 linear feet of new eight inch sanitary sewer main, five sanitary sewer manholes and easements, for six properties located on Compton Avenue, Belmont Boulevard and Delmar Avenue, are needed to construct project number 19-SL-21; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 043ES-001 on May 10, 2019, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 363 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole, and easements, and to accept approximately 278 linear feet of new eight inch sanitary sewer main, five sanitary sewer manholes and easements, for six properties located on Compton Avenue, Belmont Boulevard and Delmar Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
