Bill BL2018-1440

An ordinance amending Section 7.08.140 of the Metropolitan Code pertaining to dance permits and the permitted hours of beer sales and delivery.

WHEREAS, Section 7.08.140.N of the Metropolitan Code of Laws currently provides that it is unlawful for any beer permit holder, or his agent or employee, to “allow any dancing on his premises without a dance permit,”; and

WHEREAS, the Metropolitan Government of Nashville and Davidson County no longer issues, provides, or enforces dance permits. Chapter 6.12 of the Metropolitan Code, which previously regulated dances and dance halls, was eliminated in its entirety by Ordinance No. BL2016-221, adopted by the Metropolitan Council on June 7, 2016; and

WHEREAS, in 2014, the Metropolitan Council adopted Ordinance no. BL2014-654, creating a new subsection 7.08.140.O of the Metropolitan Code of Laws to prohibit the sale, delivery, or vehicular carrying of beer after eleven o’clock (11:00) pm or before three o’clock (3:00) am; and

WHEREAS, subsequent to its enactment, neither the Metro Nashville Beer Permit Board nor the general public has derived any particular benefit from the restrictions upon sales and delivery hours within subsection 7.08.140.O of the Metropolitan Code of Laws; and

WHEREAS, the interests and general welfare of the people of Nashville and Davidson County would be better served through the elimination of these particular provisions within Section 7.08.140 of the Metropolitan Code of Laws.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.140 of the Metropolitan Code is hereby amended by deleting subsection N. in its entirety, further deleting subsection O. in its entirety, and re-numbering the remaining subsections as necessary.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
