Bill BL2018-1103

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and fire hydrants and to accept new combination sewer mains, combination sewer manholes and fire hydrants for property located at 601 Commerce Street (MWS Project No. 17-WL-174 and 17-SL-145 and Proposal No. 2018M-004ES-001).

WHEREAS, the abandonment of approximately 536 linear feet of existing 30 inch sewer main and three fire hydrants and the acceptance of approximately 448 linear feet of new 30 inch combination sewer main, approximately 42 linear feet of new 38 inch elliptical combination sewer main, approximately 28 linear feet of new 53 inch elliptical combination sewer main, approximately 27 linear feet of new 60 inch elliptical combination sewer main, nine combination sewer manholes and four fire hydrants, for property located at 601 Commerce Street, is needed to construct project number 17-WL-174 and 17-SL-145; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2018M 004ES-001 on January 3, 2018, for the abandonment and acceptance of said sewer mains, combination sewer manholes and fire hydrants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 536 linear feet of existing 30 inch sewer main and three fire hydrants, and to accept approximately 448 linear feet of new 30 inch combination sewer main, approximately 42 linear feet of new 38 inch elliptical combination sewer main, approximately 28 linear feet of new 53 inch elliptical combination sewer main, approximately 27 linear feet of new 60 inch elliptical combination sewer main, nine combination sewer manholes and four fire hydrants, for property located at 601 Commerce Street, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
