Bill BL2019-1792

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer main and a sanitary sewer manhole and to accept new water main, a fire hydrant assembly and a sanitary sewer manhole, for property located at 2223 8th Avenue South (MWS Project No. 18-SL-69 and 18-WL-70 and Proposal No. 2019M-052ES-001).

WHEREAS, the abandonment of approximately 138 linear feet of existing eight inch sanitary sewer main and one sanitary sewer manhole, and the acceptance of approximately 32 linear feet of new eight inch water main (DIP), one fire hydrant assembly, and one sanitary sewer manhole, for property located at 2223 8th Avenue South, are needed to construct project numbers 18 SL 69 and 18-WL-70; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 052ES-001 on June 21, 2019, for the abandonment and acceptance of said water and sanitary sewer mains, sanitary sewer manholes and fire hydrant assembly.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 138 linear feet of existing eight inch sanitary sewer main and one sanitary sewer manhole, and to accept approximately 32 linear feet of new eight inch water main (DIP), one fire hydrant assembly, and one sanitary sewer manhole, for property located at 2223 8th Avenue South, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
