An ordinance amending Metropolitan Code of Laws Chapter 2.164 regarding agreements between the Metropolitan Government of Nashville and Davidson County and the Metropolitan Hospital Authority.
WHEREAS, pursuant to Tennessee Code Annotated §7-57-101 et seq., the Metropolitan Council authorized the establishment of the Hospital Authority of the Metropolitan Government of Nashville and Davidson County; and
WHEREAS, pursuant to Tennessee Code Annotated §7-57-201, the creating municipality of a Hospital Authority may enter into an agreement with the Hospital Authority for the orderly transfer to the authority of the hospital properties, functions, and outstanding obligations of such municipalities in connection with the authority; and
WHEREAS, pursuant to Tennessee Code Annotated §7-57-309, the operation of any property, real or person, conveyed or leased to an authority by a creating municipality must be operated in accordance with and under Tennessee Code Annotated Chapter 7-57 and the contracts entered into between the authority and the governing body of the creating municipality; and
WHEREAS, certain agreements were entered into by the Metropolitan Government of Nashville and Davidson County pursuant to Substitute Resolution No. SR99-1413; and
WHEREAS, it is vital that Metropolitan Nashville General Hospital remain open and continue to provide in-patient services for Nashville’s most vulnerable populations.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Code of Laws is hereby amended by adding a new section 2.164.020 as follows:
2.164.020 – Agreements with the metropolitan hospital authority
A. Until June 30, 2019, any agreement entered into between the metropolitan government of Nashville and Davidson County and the metropolitan hospital authority regarding the operations of Metropolitan Nashville General Hospital, or any successor hospital operated by the Metropolitan Hospital Authority, shall include provisions requiring the hospital to offer in-patient services.
B. Until June 30, 2019, the mayor shall not terminate any agreement between the metropolitan government of Nashville and Davidson County and the metropolitan hospital authority without prior approval of the metropolitan council by resolution.
Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
