Bill BL2018-1161

An ordinance approving an agreement between the Metropolitan Government of Nashville and Davidson County and Plaza 2750, LLC, concerning the acquisition of real property for use as the site for a new public library branch and acquisition and construction of related infrastructure improvements in Donelson (Proposal Number 2018M-009PR-001).

WHEREAS, replacement of the existing Donelson library branch with a modern facility is the top priority of the Nashville Public Library’s Facilities Master Plan; and,

WHEREAS, pursuant to the agreement (the “Agreement”) attached to this ordinance as Exhibit 1, the Metropolitan Government proposes to obtain from Plaza 2750, LLC (“Plaza”), an approximately 1.75-acre tract (the “Property”) for use as the site for a new Donelson public library branch (the “Project”) and approximately 0.875 acres for use in building related infrastructure improvements; and,

WHEREAS, pursuant to the Agreement, Plaza will construct the infrastructure improvements necessary to support the Project and the Metropolitan Government will contribute an amount not exceeding $2,000,000 toward the actual cost of the infrastructure improvements; and,

WHEREAS, approval of the Agreement is in the best interest of the citizens of Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement is approved, and the Director of Public Property Administration is authorized to execute the transactions as contemplated therein.

Section 2. The Director of Public Property Administration or his designee is further authorized to execute such documents as are customary and necessary to carry out the intent of this ordinance.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
