An ordinance to amend Title 17 of the Metropolitan Code, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending Section 17.12.040 to establish minimum setbacks for stadium, arena and racetrack uses (Proposal No. 2019Z-021TX-001).
NOW, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by amending Section 17.12.040 by adding the following provision as subsection F:
F. No private parking facility or private parking lot that is open to the public shall be constructed within 100 feet of a stadium, arena or racetrack if the facility accommodates 1,000 people or more unless a security plan prepared by a professional sports/entertainment facility security consultant is approved by resolution of the metropolitan council receiving twenty-one affirmative votes. Said security plan shall, at a minimum, include mitigation mechanisms to protect spectators from attacks associated with explosives contained within motor vehicles inside the 100 foot setback.
Section 2. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
