Bill BL2020-162 (as amended)

An ordinance amending Chapter 10.18 of the Metropolitan Code to prohibit vaping on hospital grounds and within the public right-of-way in the vicinity of hospital entrances.

WHEREAS, vaping has become increasingly common since its introduction in the United States in 2007 as an alternative to cigarette smoking; however evidence is emerging that vaping can have negative health effects, including introducing high levels of dangerous chemicals into the body and causing severe lung injury and death; and

WHEREAS, BL2012-115, passed by the Metropolitan Council in 2012 prohibited tobacco smoking on the grounds of hospitals and in the public areas outside of a hospital building and its entrances, including public sidewalks to prevent harmful side effects of second hand smoke to patients and visitors to the hospital; and

WHEREAS, scientific studies show that passive exposure to the aerosol from vaping can generate increases in serum level of nicotine metabolites similar to passive exposure to conventional cigarette smoke; and

WHEREAS, in the interest of protecting public health, the Metropolitan Council deems it appropriate to prohibit vaping on hospital property and within the public areas described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 10.18.10 of the Metropolitan Code is hereby amended by adding the following definition:

"Vaping" means the heating and aerosolization of matter which contains nicotine or other substances for the purpose of inhalation through the use of an Electronic Smoking Device (ESD).

Section 2. That Chapter 10.18 of the Metropolitan Code is hereby amended by adding the following new Section 10.18.045:

10.18.045 - Vaping on and near hospital property prohibited.

A. Vaping is prohibited on all hospital property and in the public right-of-way located within fifty (50) feet of the entrance to a hospital.
B. In addition to the prohibitions included in subsection A, vaping is prohibited in the following public areas, provided signs are posted in such areas designating them as nonsmoking:

1. Within two hundred (200) feet of all entrances to the following Vanderbilt University Medical Center Facilities:
a. Vanderbilt University Hospital located at 1211 Medical Center Drive
b. Vanderbilt Clinic located at 1301 Medical Center Drive
c. Medical Center East - North Tower located at 1215 21st Avenue South
d. Medical Center East - South Tower located at 1212 21st Avenue South
e. Medical Center North located at 1161 21st Avenue South
f. Monroe Carroll, Jr. Children's Hospital at Vanderbilt located at 2100 Children's Way
g. Vanderbilt Psychiatric Hospital located at 1601 23rd Avenue South
h. Medical Arts Building located at 1211 21st Avenue South
i. Vanderbilt Stallworth Rehabilitation Hospital located at 2201 Children's Way

2. Within two hundred (200) feet of all entrances to the following Saint Thomas Health facilities:
a. Saint Thomas Hospital West located at 4220 Harding Road
b. Saint Thomas West Medical Office Building located at 4230 Harding Road
c. NEC located at 4304-4306 Harding Pike
d. Saint Thomas Mid-Town Hospital located at 2000 Church Street
e. Saint Thomas Sports Medicine located at 2011 Church Street
f. Saint Thomas Mid-Town – Old Security Building 1914 Church Street
g. HRT Mid-State 2010 Church Street
h. Medical Office Building at Saint Thomas Mid-Town located at 300 20th Avenue North
i. Heart Building at St Thomas Mid-Town 301 21st Avenue North
j. Faith Family Clinic 326 21st Avenue North
k. Terrace Pediatrics Building 342 21st Avenue North
l. Saint Thomas Heart at Saint Thomas Mid-Town located at 222 22nd Avenue North
m. Saint Thomas Medical Partners UT Clinic 316 22nd Ave North
n. HRT – Plazas I and II 2004 Hayes Street
o. Craig Wound Care Center 2000 Murphy Avenue
p. Saint Thomas Mid-Town located at 2011 Murphy Avenue
q. Saint Thomas Medical Partners Express Care Clinic 1911 State Street

3. Within two hundred (200) feet of all entrances to the following Nashville General Hospital Health facilities:
a. Nashville General Hospital located at 1818 Albion Street
b. Nashville Healthcare Center located at 1810 Albion Street
c. Nashville Healthcare Center located at 1919 Charlotte Avenue

4. Within two hundred (200) feet of all entrances to the following Metro Department of Health facilities:
a. Lentz Public Health Center located at 2500 Charlotte Pike
b. Woodbine Public Health Center located at 224 Oriel Ave
c. South Nutrition Center located at 3718 Nolensville Pike
d. East Public Health Center located at 1015 East Trinity Lane
e. Metro Animal Care and Control located at 5125 Harding Place

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
