Bill BL2019-1495

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, a sanitary sewer manhole and easements and to accept new sanitary sewer and water mains, sanitary sewer manholes, a fire hydrant assembly and easements, for five properties located on 6th Avenue North (MWS Project Nos. 15-SL-185 and 15-WL-127 and Proposal No. 2019M-009ES-001).

WHEREAS, the abandonment of approximately 194 linear feet of existing eight inch sanitary sewer main, one sanitary manhole and easements, and the acceptance of approximately 480 linear feet of new eight inch sanitary sewer main (PVC), approximately 197 linear feet of new eight inch water main (DIP), five sanitary sewer manholes, one fire hydrant assembly and easements, for five properties located on 6th Avenue North, are needed to construct project numbers 15-SL-185 and 15-WL-127; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 009ES-001 on December 17, 2018, for the abandonment and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, fire hydrant assembly and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 194 linear feet of existing eight inch sanitary sewer main, one sanitary manhole and easements, and to accept approximately 480 linear feet of new eight inch sanitary sewer main (PVC), approximately 197 linear feet of new eight inch water main (DIP), five sanitary sewer manholes, one fire hydrant assembly and easements, for five properties located on 6th Avenue North, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
