An ordinance approving an agreement between CSX Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for payment to CSXT for costs incurred due to the existing bridge removal and construction of the new bridge at the Foster Avenue and CSX Transportation railroad crossing, DPW No. 2014-B-001, CSX OP No. 433297.

WHEREAS, CSXT has directed The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for payment to CSXT for costs incurred due to the existing bridge removal and construction of the new bridge at the Foster Avenue and CSX Transportation railroad crossing, DPW No. 2014-B-001, CSX OP No. 433297; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County agrees to cooperate with CSX Transportation as described in said agreement, attached hereto as Exhibit A and incorporated by reference, so that said construction can occur; and,

WHEREAS, the estimated cost is $341,240 and Metro has allocated funds from business unit 42404017, object code 505269; and,

WHEREAS, it is in the interest of The Metropolitan Government of Nashville and Davidson County that this construction be carried out.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section I. That the Agreement with CSXT, attached hereto as Exhibit A and incorporated herein by reference for payment to CSXT for costs incurred due to the existing bridge removal and construction of the new bridge at the Foster Avenue and CSX Transportation railroad crossing, DPW No. 2014-B-001, CSX OP No. 433297, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
