Bill BL2018-1207

An ordinance directing the termination of Contract Purchase Agreement 338266 -- a project management services agreement between Commonwealth Development Group, Inc. and the Metropolitan Government of Nashville and Davidson County.

WHEREAS, in March 2014, the Metropolitan Government of Nashville and Davidson County entered into a contract with Commonwealth Development Group, Inc. (“Commonwealth”); and

WHEREAS, this contract establishes an agreement whereby Commonwealth provides management services by serving as Owners’ Representative on large capital projects for various departments within the Metropolitan Government; and

WHEREAS, the estimated contract value at signing was eight million dollars ($8,000,000.00); and

WHEREAS, pursuant to Section 4.3 of the contract, the Metropolitan Government is authorized to terminate this contract at any time upon ninety (90) days’ written notice to Commonwealth; and

WHEREAS, the Metropolitan Council has determined that this contract is no longer in the best interests of the Metropolitan Government of Nashville and Davidson County and, therefore, the contract should be terminated.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government shall immediately exercise its right under Section 4.3 of Contract Purchase Agreement 338266 to terminate the contract upon ninety (90) days’ notice. The Purchasing Agent is hereby directed to send written notice of termination to Commonwealth Development Group, Inc.

Section 2. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
