An ordinance authorizing the abandonment and closure of a portion of the existing Crestmoor Road at the intersection of Hillsboro Pike and Crestmoor Road after the completion of a realignment project at that intersection (Proposal Number 2018M-006AB-001).
WHEREAS, pursuant to BL2017-590, the Metropolitan Council authorized the acquisition of certain parcels of property for the purpose of realigning the intersection (the “Intersection”) of Crestmoor Road and Hillsboro Pike (the “Project”); and,
WHEREAS, Tennessee CVS Pharmacy, LLC (“CVS”), the current owner of the parcel at the southwest corner of the Intersection (the “SW Parcel”), which is one of the parcels to be acquired for the Project, plans to relocate its business to the parcel at the northwest corner of the Intersection (the “NW Parcel”); and,
WHEREAS, upon completion of the Project, the portion of the existing Crestmoor Road to the south of and adjacent to the NW Parcel (the “Former Crestmoor Road”) as generally identified on Exhibit I attached hereto, will no longer be necessary for public use; and,
WHEREAS, CVS requests that the Former Crestmoor Road be closed and abandoned upon completion of the Project.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. As of the date the Project is complete as determined by the Director of Public Works (the “Completion Date”), the Former Crestmoor Road will no longer be necessary for public use.
Section 2. That within thirty (30) days after the Completion Date, the Geographic Information Systems (GIS) Street and Alley Centerline Layer for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2015-1041 is amended as follows:
The portion of the Former Crestmoor Road to the south of the NW Parcel, as depicted on the sketch attached hereto as Exhibit I and made a part of this ordinance as though copied herein, is abandoned.
Section 3. That all utility easements within the portion of the Former Crestmoor Road contemplated by this ordinance are hereby abandoned.
Section 4. That the Director of the Department of Public Works is authorized and directed, upon the enactment and approval of this ordinance, to amend the GIS Centerline Record as set out in Section 2 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.
Section 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
